Effective Date: 9 October 2026
Welcome to Attorni AI, a software-as-a-service platform operated by Arka Pvt Ltd (“Arka”, “Company”, “we”, “us” or “our”). These Terms of Service (“Terms”) govern your access to and use of the Attorni AI website, application and related services (collectively, the “Service”).
By creating an account, accessing or using the Service, you agree to these Terms. If you use the Service on behalf of an organisation, you represent that you have authority to bind that organisation. If you do not agree, do not use the Service.
1. Eligibility and Accounts
You must be at least 18 years old and competent to enter into a binding contract under applicable law. The Service is designed primarily for legal professionals and litigation-related work, although it may be made available to other adult users.
You are responsible for maintaining the confidentiality of your credentials and for activity conducted through your account. You must notify us promptly at support@attorni.ai if you become aware of unauthorised use or compromise of your account.
2. Nature of the Service and AI Disclaimer
Arka is a technology provider and is not a law firm. Arka does not provide legal representation, legal opinions or professional legal advice.
The Service may use AI to extract, summarise, search, organise or generate information based on documents and user instructions. AI systems can produce incomplete, inaccurate or fabricated content, including incorrect citations. You are responsible for independently verifying material output before relying on it.
If you are a legal professional, you retain professional responsibility for the advice you provide, documents you submit, representations you make and decisions you take. To the maximum extent permitted by law, Arka is not responsible for the outcome of any legal proceeding or professional-malpractice claim arising from a user’s reliance on unverified AI output.
3. Customer Content
“Customer Content” means documents, files, data, prompts, communications, matter information and other content submitted to or processed through the Service by or on behalf of a user or customer.
You retain your rights in Customer Content. You grant Arka a limited, non-exclusive right to host, copy, transmit, process and otherwise use Customer Content solely as necessary to provide, support, maintain and secure the Service, comply with applicable law and perform the Agreement.
Arka does not use Customer Content, prompts or customer-specific outputs to train, fine-tune or improve shared or general-purpose AI models, subject to the detailed description in our Privacy Policy and Security & AI Data Handling Policy.
4. Lawful Use and Professional Responsibility
You are responsible for ensuring that you have all rights, permissions and lawful bases required to upload and process Customer Content. You must not use the Service to violate applicable law, professional obligations, court orders, confidentiality duties, intellectual-property rights or privacy rights.
You must not use the Service to introduce malicious code, interfere with system security, attempt unauthorised access, reverse engineer protected portions of the Service except where such restriction is prohibited by law, or use the Service in a manner that materially disrupts other users or infrastructure.
5. Intermediary Activities
To the extent applicable under the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, Arka may act as an intermediary with respect to Customer Content transmitted, received or stored on behalf of users. Nothing in these Terms is intended to create safe-harbour protection where statutory requirements are not satisfied.
6. Privacy and Data Processing
Our Privacy Policy describes Arka’s processing of personal data. Where a business customer submits Customer Content containing personal data for processing on its behalf, the Arka Data Processing Addendum applies to that processing and is incorporated into the Agreement to the extent applicable.
7. Intellectual Property
Arka and its licensors retain all rights, title and interest in the Service, including software, algorithms, interfaces, branding, documentation and related intellectual property, excluding Customer Content.
If you provide product feedback, feature suggestions or other ideas that do not include confidential Customer Content, you grant Arka the right to use such feedback to improve the Service without restriction or payment. Do not submit confidential client or case information as product feedback.
8. Third-Party Services
The Service depends on third-party infrastructure, AI, storage, database and monitoring services. Arka may replace or modify such providers from time to time, subject to applicable contractual and data-protection obligations. Material subprocessors are identified in the subprocessor information.
9. Subscriptions, Renewal and Payment
Paid plans are billed according to the subscription terms shown at purchase or in an applicable order form. Unless otherwise stated, recurring subscriptions automatically renew for the next billing period unless cancelled before renewal.
Except where required by applicable law or expressly stated in an order form, fees already paid are non-refundable. Cancellation prevents future renewal but does not ordinarily provide a refund for the unused portion of a current billing period.
10. Suspension and Termination
You may stop using the Service and may delete your account or request organisational offboarding in accordance with available Service functionality and your Agreement.
Arka may suspend or terminate access where reasonably necessary to address non-payment, material breach, security risk, unlawful use, abuse of the Service or a binding legal requirement. Where reasonably practicable, Arka will provide notice and an opportunity to cure before termination for a remediable breach.
Customers should download required files before final offboarding. Bulk export of uploaded files is available through available download functionality; chat-history export is not currently supported.
11. Availability and Changes
We may modify, improve, discontinue or replace features of the Service. We do not warrant uninterrupted or error-free availability. Enterprise service-level commitments, if any, apply only where expressly stated in an executed order form or agreement.
12. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. ARKA DISCLAIMS WARRANTIES THAT ARE NOT EXPRESSLY SET OUT IN AN EXECUTED AGREEMENT, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, TO THE EXTENT SUCH WARRANTIES MAY LAWFULLY BE DISCLAIMED.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ARKA, ITS AFFILIATES, DIRECTORS, OFFICERS AND EMPLOYEES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, BUSINESS OPPORTUNITY OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE.
Except for claims arising from gross negligence, wilful misconduct or breach of confidentiality, Arka’s total aggregate liability for claims arising out of or relating to these Terms or the Service will not exceed the total fees paid by the customer to Arka during the twelve (12) months immediately preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.
14. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Arka, its affiliates and their respective officers, directors and employees from third-party claims, liabilities, damages, losses and reasonable legal costs arising from your material breach of these Terms, unlawful use of the Service, or a claim that Customer Content supplied by you infringes a third party’s rights.
15. Governing Law and Jurisdiction
These Terms are governed by the laws of India. Subject to any mandatory law or dispute-resolution terms in an executed enterprise agreement, courts of competent jurisdiction in New Delhi, India will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service.
16. Changes to Terms
We may update these Terms from time to time. Where a material change adversely affects existing users, we will provide reasonable notice by email, in-product notice or another appropriate method. Continued use after the effective date of updated Terms constitutes acceptance to the extent permitted by applicable law.
